Deceased Estate Lawyers who are
down to earth and speak your language
It is hard enough to deal with the grief associated with losing a loved one… without having to deal with the Will they left behind (or no Will at all). When you want to challenge a Will, you need to act quickly to ensure your entitlements are fully protected.
Even though people have the right to choose who inherits their estate and the law recognises this… sometimes, there are good reasons for contesting a Will.
No matter what your dispute with the Will is, Rigoli Lawyers can assist you if you have been left out of a Will, or not been treated fairly.

Left out of the Will?
We can assist you if you have been left out of a Will without good reason. Or perhaps you may have been left something but not enough considering your financial distress or unreasonable in comparison to what the other beneficiaries were left in the Will.
In Victoria wills can be challenged if the testator (Will maker) had a “moral duty” to make some provision for you, but did not, or did not do so adequately having regard to the relationship, size of the estate and many other criteria.
Cannot afford a lawyer to challenge the will?
We assist many clients who cannot afford legal fees up front. In most cases arrangements for payment can be made on the basis that their legal fees get paid from the deceased estate first, or from their share of the estate entitlement, once a claim is resolved and payout made.
We will sit down with such clients and work out firstly if their claim is a good one, and secondly assess all risk factors and thirdly if it appears to us to be a suitable case to fund, we can offer a deferred payment arrangement so clients can pay at the end when they get their inheritance.
In Australia, every State has it’s own legislation regarding rights of a person to challenge a will which may differ from other States. This article deals with the situation in Victoria.Read More
